A special court of the National Investigation Agency (NIA) on Friday sentenced Mohsin Syed and Rizwan Ahmed, who had gone from Mumbai to join ISIS, to eight years in jail. They were convicted by the court on Thursday under Section 20 of the Unlawful Activities (Prevention) Act (UAPA). A fine of Rs 10,000 each has also been imposed on both. In case of non-payment, the punishment will be extended by 3 months.

In their application, both these people had admitted to the crime of joining the terrorist organization IS in 2015. NIA Special Judge AT Wankhede said that both the accused Mohsin Syed (32 years) and Rizwan Ahmed (25 years) had moved the special court last month to plead their guilt in the case. On Wednesday, January 5, the court had informed both the accused about the charges and the punishment to be given if proved guilty.

Life imprisonment was not done for confessing the crime
Under the provisions of the UAPA and the Indian Penal Code (IPC), both could face a minimum sentence of three years and a maximum of life imprisonment. But both had confessed their crime, so the court sentenced both of them to 8 years of imprisonment. The accused told the court that they were already aware of the sentence, yet both of them had sought to confess their crime on their own volition.

There was an allegation of making terrorists by taking boys from Mumbai
According to the prosecution, four people living in Mumbai’s suburban Malwani had left their homes in 2015 to join ISIS. The NIA claimed that Syed and Ahmed instigated, intimidated and influenced the economically weaker Muslim men of Malwani. Along with this, Muslim boys were also forced to join terrorist organizations and become fidayeen.

After leaving the country, a case was registered at Kalachowki police station in Mumbai. All of them were accused of traveling abroad to become members of IS/ISIL/ISIS to wage war against the allied nations of India. The Anti-Terrorism Squad (ATS) was probing the case. The case was later handed over to the NIA, which re-registered the case. The NIA had filed the charge sheet in July 2016 after completing the investigation.
