Shimla Justice Anoop Chitkara, while allowing the anticipatory bail plea, said that drug trafficking is a punishable offense but a pregnant woman being a criminal can prove fatal to the unborn child throughout her life if she is born in jail. A child born in a prison may have to face mental stress when it comes to his birth. Such a trauma will not allow him to lead a social life. Pregnant women involved in crime or accused can also get nutritious food in jail but not free from mental stress.

Being confined within the boundary wall can cause mental stress to the pregnant woman. Giving birth in prison can cause severe trauma to the mother. The court said that if the punishment of pregnant women is postponed for about one year before and after the birth of the child, there will be no difference in the society. Every woman has the right to lead a dignified life during motherhood. Pregnant women need bail not jail. No matter how big the crime is, they should be given temporary bail at least at such a time.
