Actress Shilpa Shetty had filed a defamation case against 29 media organizations in this case.

The hearing of the defamation case filed by actress Shilpa Shetty against 29 institutions and individuals went on for a long time on Friday. After the hearing, the court has neither given any relief to Shilpa nor imposed any restriction on media reporting. However, some YouTube video reports have been questioned. The court said that it is not defamation to write or broadcast information related to the investigation by quoting sources. However, the court has also said that there should be no comment on the personal life of a celebrity or the upbringing of their children. Let us inform that in her petition before the Bombay High Court, actress Shilpa Shetty has said that her image is being maligned through false reporting in the pornography case.

The court agreed that Shilpa’s right to privacy has to be maintained. Shilpa’s children, and their upbringing, cannot be talked about in this whole matter. During the hearing of the case, the Bombay High Court has asked the lawyer of the actress that if the media is running the news citing sources, then how is it wrong and defamatory. The High Court has also told the lawyer that there is a case against the husband of your client and this court will not interfere in any way. Anyone can be your client, but there is a law for defamation.

Referring to a Bollywood website, the court said that it is directly related to the ongoing investigation against Raj Kundra. The report says that Shilpa is suspected of destroying evidence. Prima facie it appears that this article has been written with the understanding of the investigating agency. The reporting is not on Shilpa’s innocence or guilt, it is based on police observation.

Shilpa’s lawyer said – children are being affected by media reports
Shilpa’s lawyer told the court that the reports being published by the media affect her (Shilpa’s) children. Reports about her crying reveal that she is human. Shilpa’s lawyer told the court that some things are part of a journalist’s conduct. I cannot comment on the standard of journalists. These journalists don’t follow standards.

On this, the court asked- Now do you expect the court to sit down and investigate which sources are cited by the media houses for each story? The court said that anything which has been reported on the basis of police sources is not defamatory.

What the court said, ‘We do not know whether he (Raj Kundra) is a guilty or not. We are not saying anything about it. But reporting what the crime branch is saying during the investigation or what the police is saying cannot be defamation. The Bombay High Court also said that those who have been made accused in this case should also get a chance. On this, Shilpa’s lawyer said that some media persons are dragging the name of her mother, child and family in Raj Kundra’s case. The court has summoned the owners of two YouTube channels to respond in this matter on September 20.

Not all to blame for one’s fault
Shilpa’s lawyer cited a video made by a YouTube channel, one of the accused in the case. The court said- I will not allow you to take the example of one defended and apply it to all the other defended. The court also said that what you are expecting me to do will have very serious consequences on the freedom of the press. On this matter, the court said- You give me a personal example of a defended saying malicious things, I will look into it but the news based on police sources cannot be called malicious and derogatory.
