Bhaskar learned from Supreme Court lawyer Siddharth Shinde what options the government would have after the January 10 decision…
Option 1: If Shinde Sena is disqualifiedChief Minister Shinde will have to resign immediately. Technically the government will fall. Although Ajit Pawar’s NCP faction will have more MLAs than the majority, the grand alliance government will come again, but the Chief Minister will be someone else. Disqualified Shinde will not be able to take oath again.
Option 2: If Shinde Sena is declared eligibleShinde’s government will continue. The Thackeray group had first issued notices to 16 MLAs and later to 24 MLAs. Therefore this decision will be applicable to all 40 MLAs. There is a possibility of a decision on similar lines in the MLA disqualification case of Ajit Pawar group.
Option 3: No one will be disqualifiedShiv Sena changed the Constitution in 2018, but the Election Commission said that it did not receive information about the change in the Constitution. Therefore, on the basis of majority of public representatives, the Commission handed over the party and symbol to Shinde. The Speaker of the Assembly can say that no one can be disqualified on this basis. But the chances of this happening are less.
