The court has said that the schools are closed. They do not have to bear the cost of many facilities offered on campus. Hence the cost of operation is reduced. Therefore, they must reduce the fees of online classes.

Several schools in Rajasthan had filed a petition in the Supreme Court against the state government’s decision directing the schools to waive 30% of the fees. A bench of Justices AM Khanwilkar and Justice Dinesh Maheshwari said – there is no law that empowers the state government to issue such an order, but we also believe that the schools should reduce the fees.

The court said, “Management of educational institutions should show sensitivity. People are facing troubles due to the epidemic. Schools should take steps that provide relief to children and parents.

The Supreme Court emphasized that the facilities provided to the students in the campus are not available to them in the current situation. In such a situation, the schools are benefiting from its payment and the schools should definitely avoid this benefit. By law, schools cannot charge school fees for such facilities, which students are not able to get due to these circumstances.

The court said that charging fees for such facilities is like earning profits and engaging in commercialization. Schools do not open due to complete lockdown for a long time in 2020-21, they all know and the law has also been taken into notice. Certainly, schools must have saved recurring expenses on petrol-diesel, electricity, water, maintenance and cleanliness.
